Terms and Conditions
Learn to Drive with David is the trading name of David Browne.
Terms used throughout this document.
The instructor, the person that is delivering the lessons
The pupil is the person that is taking the lesson.
Outsourced Pupils.
As a franchisee with other driving schools (franchisor), then you are considered their pupil, and as such their terms and conditions will apply. The privacy policy will have a shared responsibility. You can find a copy of the outsourcing driving school’s terms and conditions on their website, or they will be supplied to you in the first lesson.
Driving Licence.
The instructor will check the licence on or before the first lesson. Then it is the pupil’s responsibility to ensure they have a valid licence to drive the tuition vehicle. If during the time that they are receiving driving tuition. The pupil must inform the instructor if you receive any endorsements on your licence or have been disqualified from driving whilst receiving driving tuition.
Your entitlement to drive.
You must have a UK Provisional/Full Driving Licence with you on your first lesson, your Share Driver Information code. The instructor will check your eyesight (You must read a car registration plate at a minimum of 20.5 meters old-style number plate or 20 metres for the new style). Suppose your vision is not at the standard for driving, or your driving licence is invalid. Then you will be charged for the lesson at the current hourly rate and the lesson stopped, or the lesson will continue as a theory-based lesson.
Full Driving Licence.
Pupils with a Full driving licence will be charged £41.00 per hour. No offers or promotions will apply.
Provisional UK Driving Licence (Learner Drivers).
Hourly rate is £36.00 per hour. Special offers and promotions are available to new and existing pupils unless stated otherwise.
Pupil offers.
You can use any offer or promotion for 1 year or until your first practical driving test, but they may be cancelled at any time and depend on the following conditions: –
- Promotions are for new pupils to Learn To Drive With David.
- Promotions are conditional on not having a driving test booked at time of contact.
- Having regular lessons of no more than two weeks apart (Unless agreed otherwise)
- Having no more than 2 short notice cancellation of less than 24hrs
- All promotions are as advertised and subject to change or withdrawal without notice.

Driving Tests.
Pupils may book their practical driving test with the consent of the instructor, should a pupil book a practical driving test without the permission of the instructor. The instructor reserves the right to end tuition.
If you wish to use the instructor’s vehicle for the practical driving test, you must pay in advance of the practical test date for the hire of the car at the current rate of a minimum of 2.5 times the Standard Hourly Rate.
The instructor reserves the right to withhold using the tuition vehicle for use on the test if the instructor believes that the pupil is not ready for the practical driving test and may be a danger to themselves or others. The instructor will give a reasonable amount of time so that the pupil loses no monies due to withholding the car or for cancellation of their driving test. Any practical driving/theory tests that are cancelled by the DVSA the Instructor cannot be held responsible for but will advise accordingly. Also, I will collect you in a reasonable time to travel to the test centre but cannot be held accountable for lateness to the test centre due to traffic or weather conditions.
Intensive courses.
will be charged at the standard hourly rate and are subject to availability. The courses are one week or two weeks. The instructor will also add the cost of Theory and Practical tests to the price of the course as required.
Recommended Hours.
Beginner-: No previous experience 40+hrs
Novice: – Had a few lessons 30+hr
Competent: -Covered all the syllabus 20+hrs
Test standard: -Failed a test or considered as test-ready 6+hrs (The number of hours needed depends on how quickly you learn and is intended as a guide only).
Intensive courses.
Will need a 30% deposit and all test fees paid in advance of acceptance to the course, with the total amount payable on the commencement of the course, a 14-day cancellation policy on intensive courses. If you cancel the course within 14 days of the start of the course, then your deposit is lost. Outside of the 14 days, the instructor will give a full refund, minus any test fees paid.
Driver Active and Theory Test Pro.
Driver Active and Theory Test Pro are external site’s that I have no affiliation to or control their content, I will supply you with a voucher code for driver active that will grant you 90 days of access to the website. Theory test pro may be used until you pass your theory test or cease tuition with Learn to Drive with David. Both may be removed without notice or warning.

I have no control to their content and take no responsibility for their content and suitability and that I am not affiliated to them. However, Admin will check websites at regular intervals for appropriateness, and their content is suitable for learner drivers (16+). Any found inappropriate or reported to me will be removed from my website ASAP (24hrs).
Cancellations and Termination.
A pupil may cancel a driving lesson or change the date of the driving lesson by giving a minimum of 48 hours’ notice. When a pupil cancels a driving lesson with less than 48 hours’ notice on the second occasion and all subsequent lessons thereafter, then a cancellation fee of £31.00 will be charged. When the instructor cancels a driving lesson on the second occasion with less than 48 hours’ notice, the instructor will rearrange the lesson to suit both instructor and the pupil and give a 1 hour free, to be used on the next lesson. Except when the cancellation by the instructor is for mechanical breakdown of the vehicle, Theft of vehicle, Accident in-vehicle, extreme bad weather or force majeure, in that case, the instructor will rearrange the lesson for the next available time that suits both the pupil and the instructor.
The instructor will cancel a lesson at short notice.
When the instructor suspects that the pupil may be unfit to drive because of alcohol, drugs (prescribed or otherwise), or any medical condition that would cause his/her driving to be illegal. Then the pupil will be charged for the lesson at the current hourly rate.
Late cancellation policy due to effects of Covid-19.
You must inform the instructor as soon as possible to cancel the lesson, there will be no charge made, also the instructor will inform the pupil at the earliest time to cancel a lesson. Should either fail to inform other party of less than 1 hours’ notice then the lesson will be charged for at the normal cancellation terms above and have no further lessons for a minimum of 10 days.
Refunds and Termination of Driving Lessons.
When a pupil does not contact the instructor for 28 days after the last lesson (Unless previously agreed with the instructor), then the pupil will be seen to have ceased driving tuition. Also, when the pupil wishes to end tuition at the pupil’s request. The instructor will refund any monies owed to the pupil via the original method of payment.
Where an offer is in place, then the standard hourly rate of £31.00 per hour will be charged for hours already taken under the special offer. The instructor will also charge an admin fee of 5% of the original transaction.
PPE and Vehicle.
Face masks will be used by the instructor and will be up to the pupil whether they wish to wear a face mask whilst inside the car. The instructor will conduct at regular cleaning and sanitization of the inside of the vehicle and vehicle touchpoints.
You must check for the latest advice from the GOV.UK website and information from your instructor about driving lessons.
Should you catch COVID-19 while taking tuition, the instructor cannot be held responsible for catching COVID-19. Similarly, the instructor cannot hold the pupil accountable for catching COVID-19.
Your rights as a consumer.
These Terms and Conditions are to avoid misunderstanding and do not affect your statutory rights as a consumer and are based on the ADI code of practice.
